1. Introduction

These Terms of Service ("Terms") govern your use of mumzmart.com (the "Site") and your purchase of products from MumzMart (the "Services"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. About MumzMart

MumzMart is an online store operated by Heenans Enterprises LLC, a limited liability company organized under the laws of the State of Wyoming, United States, with its registered address at 1309 Coffeen Avenue, Ste 1200, Sheridan, WY 82801, USA. Our products are sourced, warehoused, and fulfilled from our operations center in Dubai, United Arab Emirates. References to "MumzMart," "we," "us," or "our" mean Heenans Enterprises LLC.

3. Definitions

"Items" means the products offered for sale on the Site.
"Order" means a purchase of one or more Items placed by you through the Site.
"You" or "your" means the person or entity using the Site or placing an Order.

4. Our Products

MumzMart sells a mix of new and preloved (secondhand) baby, kids, and family products. Each product listing indicates whether an item is new or preloved. Preloved items are inspected and described to the best of our ability but may show reasonable signs of prior use consistent with their described condition. We encourage you to review product photos and descriptions carefully, or contact us with questions, before ordering.

5. Accounts

You may browse and shop as a guest or create an account. If you create an account, you're responsible for keeping your login credentials confidential and for all activity under your account. You must be at least 18 years old, or have a parent/guardian's consent, to create an account or place an Order.

6. Orders & Payment

By placing an Order, you're making an offer to purchase the selected Items at the listed price. We accept payment through Stripe and Tabby (Buy Now, Pay Later). An Order is confirmed once payment is authorized and you receive an order confirmation email. We reserve the right to refuse or cancel any Order, including in cases of pricing errors, suspected fraud, or unavailable inventory, in which case you'll be refunded in full.

7. Pricing & Availability

All prices are listed in USD unless otherwise stated and are subject to change without notice. Because much of our inventory is preloved and one-of-a-kind, availability is not guaranteed until your Order is confirmed. If an Item you ordered becomes unavailable, we'll notify you and issue a full refund for that Item.

8. Shipping & Delivery

Shipping rates, delivery estimates, and coverage areas are set out in our Shipping Policy. Delivery times are estimates only and are not guaranteed. Risk of loss and title for Items pass to you upon delivery to the shipping carrier.

9. Returns, Refunds & Cancellations

Our return and refund terms are set out in our Refund Policy. In summary: because most of our inventory is secondhand and sold as described, we operate a limited returns policy. You must report any item that arrives damaged, defective, or materially not as described within 48 hours of delivery in order to be eligible for a refund or replacement.

10. Prohibited Conduct

You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorized access to the Site or its systems; (c) interfere with the proper working of the Site; (d) submit false or misleading information; or (e) use automated means (bots, scrapers) to access the Site without our written permission.

11. Intellectual Property

All content on the Site, including text, graphics, logos, and images, is owned by or licensed to MumzMart and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written consent.

12. Third-Party Links & Services

The Site may contain links to third-party websites or use third-party services (such as payment processors and shipping carriers). We aren't responsible for the content, policies, or practices of any third party.

13. Disclaimers

The Site and all products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Given the nature of preloved goods, we make no guarantee as to the condition, safety certification, or remaining lifespan of secondhand items beyond what is stated in the product listing.

14. Limitation of Liability

To the fullest extent permitted by law, MumzMart and Heenans Enterprises LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Site or purchase of any Item. Our total liability for any claim arising out of or relating to these Terms or your Order will not exceed the amount you paid for the Item(s) giving rise to the claim.

15. Indemnification

You agree to indemnify and hold harmless MumzMart, Heenans Enterprises LLC, and our officers, employees, and agents from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Site.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming, USA, and you consent to personal jurisdiction there.

17. Force Majeure

We won't be liable for any delay or failure to perform resulting from causes outside our reasonable control, including natural disasters, war, civil unrest, labor disputes, government action, power or transportation failures, epidemics, or third-party supply chain disruptions.

18. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted to this page. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
